Welcome to Martial LMS. These Terms and Conditions (“Terms”) govern your access to and use of the Martial LMS platform, websites and related services (collectively, the “Service”), operated by Martial Jenga Labs from Suite 1616, 16th Floor, Viewpark Towers, Utalii Lane, Nairobi, Kenya (“we”, “us” or “our”). By accessing or using the Service you agree to be bound by these Terms.
You must be at least 18 years old and able to enter into a binding contract under Kenyan law to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account.
You agree not to misuse the Service. In particular you may not (a) attempt to gain unauthorised access to any system or data; (b) upload material that is unlawful or that infringes third-party rights; (c) use the Service in a way that breaches the Advocates Act, the Law Society of Kenya code of conduct, or any other applicable Kenyan law; or (d) interfere with the integrity or performance of the Service.
Plans are billed in Kenyan Shillings (KES). Subscription fees are charged in advance and are non-refundable except where required by Kenyan consumer law. Applicable VAT and withholding tax will be applied per KRA rules. You may cancel your subscription at any time; access continues until the end of the paid period.
Data you upload remains yours. We act as a processor of that data, store it securely (encrypted at rest and in transit), and will not sell it. You can export your data at any time. Our handling of personal data is governed by our Privacy Policy and the Kenya Data Protection Act, 2019.
We aim for high availability but do not guarantee uninterrupted service. We may perform planned maintenance and will give reasonable notice where practical. We are not liable for downtime caused by upstream providers, force majeure or circumstances outside our reasonable control.
The Service, its design, code and content (excluding your own data) are owned by Martial Jenga Labs and protected by copyright, trade-mark and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
To the maximum extent permitted by Kenyan law, Martial Jenga Labs is not liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue or data. Our total aggregate liability arising out of or relating to the Service is capped at the fees paid by you in the twelve months preceding the claim.
You may cancel your account at any time. We may suspend or terminate accounts that breach these Terms or that put the Service or other users at risk, with notice where reasonably practical.
These Terms are governed by the laws of the Republic of Kenya. Disputes will be submitted to the exclusive jurisdiction of the Courts of Kenya, save that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.
We may update these Terms from time to time. Material changes will be communicated via the Service or by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
